One of the most unsavory jobs about being a landlord is when it comes time to evict a tenant because they have not paid their rent. Eviction can be a difficult process that is complicated by being time consuming and expensive for the landlord that must undertake it. Each state has different laws but most landlords must start with an eviction notice. If you do not already have an eviction notice handy you can download an eviction notice form off the Internet.
You will need to fill out your eviction notice form with the pertinent information and as soon as the late payment grace period has expired you can serve the notice to your tenant. This notice will inform them that they have a certain amount of time in which to make their rent current and if they do not do so you will be filing for an eviction in court against them. Be sure to check with the state to see if there is a specific eviction notice forms that you will need for that state. Some states require special forms and others do not.
If you are evicting your tenant for something other than not paying their rent you will need to fill out a different type of eviction notice forms and the form must have a place for you to list the reason for eviction on the form. If you are evicting them for lease agreement violations the tenant must by law be given a certain number of days in which to correct the violations before you can proceed with the eviction process.
If the tenant does not comply with the demands of the eviction notice you will then need to go to court to get an order to have them evicted. You will need to file a form with the courts and then send a copy of the form to the tenant. Once you have filed the complaint the court will set a date where you will have a chance to tell them in person why you want the tenant evicted and they will have a chance to refute your claims. In most cases this is a formality because if the tenant has failed to pay then he must provide proof to the contrary in order to refute that type of eviction.
Once the court has ruled in your favor the ruling goes to the Sheriff’s office and another eviction notice form is issued to the tenants stating the date that they must be out by. While this process can be a lot of work and cost you a lot of money following the steps carefully can help you get through it a bit quicker and easier.
